The Investigative Hearing

Protecting Your Rights During the Administrative Hearing

Many people are uncertain about how to present certain aspects of their past on the Bar application. Although you may have tried to explain yourself in a positive light, if there was a concern with your application, or if a character and fitness issue arose, you may be facing an investigative hearing before the Florida Board of Bar Examiners.

This is a terrifying process for most applicants. If you are noticed for an investigative hearing as part of the Bar admission process, an experienced lawyer can help protect your rights — and your career. At Ferrer Shane, PL, we represent clients throughout Florida. Contact our firm online or call 305-432-9774 to schedule your free initial consultation.

What Happens in the Investigative Hearing?

During the Florida Bar admissions investigative hearing, you will be questioned before the Florida Board of Bar Examiners. You will answer questions under oath, and you will be asked questions about anything — regardless of whether it is on your Bar application. Everything discussed at your investigative hearing should be consistent with your law school application and your Florida Bar application. Any inconsistencies will prompt the Board to seriously question your fitness to practice law.

Maintaining Composure and Disclosing Your Past

If your investigative hearing does not go well, the Board may file specifications against you and may require a formal hearing. Although you are responsible for explaining your past, an attorney can be a valuable asset. Any attorney can offer the comfort and confidence you need to perform well during the investigative hearing, move exhibits into evidence, and help to clarify your explanations during the hearing.

The investigative hearing is a highly stressful situation, and not a situation you want to encounter without help. Going alone is like going to trial without an attorney. Your attorney may make a difference between not immediately being admitted, being admitted with a conditional admission, or being admitted outright.

We are here to help protect you. Contact our firm online or call 305-432-9774 to schedule your free initial consultation.
